Pacific Grove City Council Weighs in on Short Term Rentals

Monterey >> After 4½ hours of public comment and debate about if and how short-term rentals should exist in Pacific Grove, the City Council voted 4-3 to continue to allow them.

That decision was just the first followed by a series of amendments discussed to determine future standards and restrictions on the complex topic.

Among the changes to be instituted are:

• Safety and health inspections will be required of short-term rental applicants.

• Neighbors within 300 feet be notified about a short-term rental.

• A cap of 260 short-term rental units in the city was agreed upon. There are currently more than 180 registered units in town.

“What we asked was that city staff look at how to really ensure that we don’t have too high density in a small cluster,” said Mayor Bill Kampe.

Council members also agreed upon instituting a hotline, which would give any resident a place to call if they have a complaint about a short-term rental. A guidebook to include ordinances and helpful hints will also be created with the intent to help operators understand the laws and how to operate their business. All existing license holders of short-term rentals will be grandfathered in under the current restrictions for 18 months.

All changes were based on the agenda report, prepared by City Manager Thomas Frutchey, which resulted from the recommendations of the city’s citizen task force that formed six weeks ago.

Councilman Daniel Miller said he didn’t think the task force was needed in the first place.

“We don’t want to have these businesses checked and want to require you to live up to building codes,” said Miller. “It is a zoning question. It needs to be at the Planning Commission. I never wanted this task force because I think it’s going to slow the whole process down.”

To that Councilwoman Casey Lucius stressed the council had an important responsibility to make a decision on the issue immediately.

“We went through zoning discussion, we voted as a council that we would continue with (short-term rentals) so I hope we move forward and if we do nothing else, we can start these,” said Lucius.

Tuesday night marked the 15th time the subject had come before the City Council, yet the dialogue from council members and the public still seemed fervent.

“The task force doesn’t safeguard the quality of life of residential areas,” said resident Regina Doyle. “… Instead of seeking (transient occupancy taxes), please ask residents if (short-term rentals) are in our best interest.”

Pacific Grove resident Evin Ollinger had a different view.

“Our hometown was founded by vacation renters and here we are so many years later still discussing this,” said Ollinger. “Please manage and inspect absentee owners, but less regulations please. Short-term rentals bring in nearly $1 million in revenue to the city’s general fund. The impact of $1 million is big.”

Resident Chip Bates noted that small and large communities along the coast from Portland and San Diego are grappling with the same problem.

“There are several issues that remain unanswered and potentially very divisive, particularly the number and density,” said Bates. “All over the country it’s a disputable issue but don’t drive (short-term rentals) underground. We have to find a balance.”

My response:

Hi (Monterey Peninsula Home Team Client),

Pacific Grove has a very eclectic mixture of homes with a wide variable of price enhancers, such as proximity to town, proximity to the water, ocean view or not, not to mention condition.  As such, our price per square foot can vary widely from as low as around $300/sq. ft. to as high as well over $1000/sq ft. In addition, generally speaking, smaller homes have higher price per square foot ratios than larger homes, so that needs to be taken into account as well.
 
842 Sunset is actually a very aggressively priced home for Pacific Grove and will likely sell for close to the asking price, even though it is in nearly original condition.  This home is located in the Washington Park Neighborhood.

As you can see, 842 Sunset is the lowest priced home per square foot in the Washington Park neighborhood currently offered for sale, which has to do primarily with it’s location.  This part of Sunset Drive is rather busy with traffic and it is a little bit of an inconvenience to get out of your driveway as cars tend to go faster on this section of road.
 
So to answer your questions, there really isn’t a price per square foot average that is useful for determining value across the entire city.  It is only useful when comparing like homes that are similar in size, features and location. This home, given it’s condition and location is probably priced right in terms of price per square foot in this neighborhood of Pacific Grove...

The 2015 Monterey Car Week is almost here.  It seems like just a few months ago the streets were alive with the sound of exotic and classic cars from the 2014 Monterey Car Week. The town is already a buzz with all of the set up and anticipation of this years events.  I have noticed locals getting their prized possessions detailed and ready to show off while the auto transporters have been busy bringing in out of town vehicles for the week.

Monterey County Short Term Rental and Special Event Information

Information from Monterey County on Short Term Rentals and Special Events

The following information was taken from an email sent to all Realtors from Kevin Stone, the Government & Community Affairs Director for the Monterey County Association of Realtors.  

Short Term Rentals

The issue of renting one's property, specifically on a short term basis, has been a topic clouded in confusion over the past year - especially with the increased number of owners looking to take advantage of tools such as VRBO. Below is a synopsis from the County of Monterey (all unincorporated areas) on current policy as it relates to renting one's property. Again, this is applicable to all unincorporated areas within Monterey County.

-          Long term rental (more than 30 days) for residential purposes is not regulated.

-          Non-Coastal Areas.  Short-term rentals are allowed for 7-30 days with an Administrative Permit processed through RMA-Planning (Monterey County Core Section 21.64.280).  Rental for less than 7 days is not allowed.  Bed & Breakfast use is allowed with a Use Permit processed through RMA-Planning (Monterey County Core Section 21.64.100).  Administrative Permits and Use Permits are discretionary permits that include public notice and conditions. 

-          Coastal Area.  Short term rental in coastal areas less than 30 days is not permitted.  Bed & Breakfast use is allowed with a Use Permit processed through RMA-Planning (Monterey County Core Section 20.64.100).  

-          Special Events. Renting property or a home for events in coastal or non-coastal areas requires a Use Permit for assemblage of people processed through RMA-Planning.  Hosting an event at your personal property may still require a permit.  For example, exchange of compensation (e.g. money) is an indicator of an event that requires a permit.  There are areas that will not support events due to constraints such as water and/or traffic.  

NOTE: Renting a home for less than 30 days is also subject to Transient Occupancy Tax (TOT), which is a Business Code that is applied and enforced separate from land use.  Paying TOT does NOT imply, or alleviate obligation for, land use compliance.  Owners found to be renting homes without proper land use permits, regardless if TOT is paid, are subject to penalties, including fines.

A Short Term Rental Ordinance is in the works... 

County staff held multiple community meetings over the past year or so.  Draft ordinances were developed that separate out Short Term Rentals and Events, and that would apply countywide (coastal and non-coastal areas).  Supervisor Potter (District 5) convened a STR (Short Term Rental) Workgroup that met multiple times between April and May 2015.  The County will meet internally in June to discuss STR Workgroup outcomes to date and begin re-drafting a Countywide ordinance.  We anticipate we'll be drafting the ordinance and meeting with STR Workgroup through mid-summer (2 or 3 more meetings), then look to roll out a draft ordinance to the public in late summer (August 2015).  Separately County staff is meeting, by invitation from Supervisor Potter, with the Big Sur Local Coastal Program Defense Committee. This committee's desire is to meet and discuss prohibiting STRs in the Big Sur area.  

Code Compliance is generally reactive and complaint driven.  However, there are many citizens that are actively seeking unpermitted rentals and/or events and reporting them to the County.  The County will actively enforce any complaints received.  If the County finds advertisement with errors regarding what is allowed, code compliance staff will  attempt to send a courtesy notice to the Realtor identified in the notice.  Once a courtesy notice is sent, the County expects compliance and will begin citing a violation.  

Again, this is information that comes directly from the County of Monterey. Prospective buyers or current property owners who have an interest in short term rental or special event use should contact the County directly. Stevenson School a Block Away
